Gentlemen:
David Tanksley, a delegate from Local Union 327, filed a protest pursuant to
Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against Willie Ellis, secretary-treasurer of Local Union 327. The protester alleged that the local union improperly made an airline reservation for him to arrive at the International Convention on Saturday, July 13, 1996, rather than on Sunday,
July 14. The protester further alleged that the local union required him to pay his own hotel bill for the evening of July 13, while the local union remained responsible for his accommodations beginning July 14. The protester sought to hold the local union responsible for his hotel bill for the evening of July 13.
After filing his protest, the protester notified the Election Officer that he wished to withdraw his protest. Finding that the withdrawal effectuates the purpose of the Rules, the Election Officer permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.
