Re:  Election Office Case No. CONV-34-IBT

 

Gentlemen:

 

Louis DiDio, a member of Local Union 812, filed a protest pursuant to Article XIV, Section 2(b) of the Rules for the IBT International Union Delegate and Officer Election (Rules) against the IBT.  Mr. DiDio alleges that the rules which applied to and controlled the voting procedures on union business at the 1991 IBT Convention have not been followed at the 1996 IBT Convention.  He cites several examples of how, in his view, these rules have been violated.

 

New York City Protest Coordinator Barbara C. Deinhardt was assigned to this protest.

 

Pursuant to the Rules at Article I, the Election Officers has authority to supervise all phases of the International Union delegate and officer election.  Under the Consent Decree, the Election Officer has exclusive jurisdiction over the IBT election to select delegates and alternate delegates to the Teamsters 25th International Convention and select International officers from the candidates nominated.  Bodine, CONV-17-IBT, et seq. (July 16, 1996).   This grant of power does not extend to any other union business, including any unrelated event which takes place on the Convention floor.  When there is no evident connection between the

matter protested and the election, as is the case with the parliamentary procedures used at the Convention, the Election Officer does not intervene.  Rodriguez, CONV-37-IBT (July 18, 1996).

 

The allegations of the protest do pertain to voting matters of union business outside of the election process.  The protest does not relate to any phase of the election of International delegates or officers supervised by the Election Officer.

 

Accordingly, the protest is DENIED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
