DETERMINATION OF THE ELECTION OFFICER

 

Gentlepersons:

 

On Tuesday, July 16, 1996, Election Officer Barbara Zack Quindel presided over the IBT Convention floor nominations for regional vice presidents.  The Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) at Article IV,

Section 5(c)(1) set forth the following with regard to the nomination of candidates for this position:

 

During the morning session of the second day of the Convention, delegates shall place from the floor of the Convention into nomination, and second, candidates for the regional Vice President positions.  Following the close of regular business of the afternoon session on the second day of the Convention, delegates shall, by secret ballot, nominate candidates to run for regional Vice President positions from among those receiving floor nominations. With respect to the nomination process for regional Vice President positions, participation shall be limited to delegates in the relevant delegate pool.

Johnnie Brown, a delegate from Local Union 804 in New York, New York, nominated Lorelei Anderson for the position of Vice President Central Region.  Mr. Brown is not within the delegate pool of the Central Region.  While in line at microphone #2, which was designated as the nominator microphone by the Election Officer, Mr. Brown was advised on three separate occasions by Election Officer Representative William B. Kane that he should get someone else who was from the Central Region to nominate Ms. Anderson.  Despite these instructions, Mr. Brown proceeded to nominate Ms. Anderson.

 

Ms. Andersons nomination was seconded by Chris Schweitzer, a delegate from Local Union 896 in Los Angeles, California.  Ms. Schweitzer is not within the delegate pool of the Central Region.

 

At the conclusion of the nomination process for the regional vice presidents, it was immediately brought to the attention of the Election Officer that the nominator and seconder for Ms. Anderson were not from the Central Region and, thus, Ms. Andersons name was not properly placed in nomination.

 

It is the duty of the Election Officer to oversee the election of International officers and to guarantee a fair, honest, open and informed election.  In so doing, under the Rules, the Election Officer directly presides over the nominations process conducted at the International Convention.  The requirement that regional vice presidents have nominators and seconders from the region they will run in and may ultimately represent, rather than the union at large, ensures geographic support from the region in which that person is a candidate.  This requirement under the Rules is without exception.

 

In these circumstances, the Election Officer finds that Ms. Anderson was not properly nominated and cannot appear on the ballot for candidates nominated from the floor for the position of regional vice president, Central Region.

 

Since the secret ballot nomination vote for the Regional vice presidents will take place beginning at 5:00 p.m. on July 16, 1996, and in light of the fact that this is a Determination of the Election Officer rather than a protest, Ms. Anderson has the right to immediately request a hearing in writing.  The request shall be served on:
