David Dethrow, a member of Local Union 688, filed a post-election protest pursuant to Article XIII, Section 3 of the Rules for the 2000-2001 IBT International Union Delegate and Officer Election ("Rules") against Local Union 688. The protest alleges the local retaliated against Monica Droege, a supporter of the Tom Leedham Rank & File Power slate ("Leedham slate"), by barring her from a gym operated by the local's Insurance & Welfare Fund for the fund's members.

Election Administrator representative Jeffrey Ellison investigated the protest.

Investigation shows that Walter Strosnider, the person in charge of the gym, barred Droege from the gym, saying that Joseph Galli, the local's secretary-treasurer, would not want her to use the gym because of her political beliefs. Strosnider has since advised Droege in writing that his statement was inappropriate and inaccurate, and that she will continue to be admitted to the gym on the same terms that she was admitted previously. On this basis, we deem this protest RESOLVED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Administrator in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
