ORDER
This matter is an appeal from the Election Supervisor's decision 2006 ESD 216 issued April 28, 2006.
A hearing was held before me on May 3, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven R. Newmark on behalf of the Election Supervisor, Barbara Harvey, Esq. on behalf of Teamsters for a Democratic Union, David Hoffa, Esq., Todd Thompson and Christie Bailey on behalf of the Hoffa 2006 Campaign, Louie Nikolaidis, Esq. of Lewis, Clifton & Nikolaidis, P.C. on behalf of Local Union 805 and Walter Kane, Esq. of Cary Kane LLP on behalf of Yanko Fuentes.
For reasons stated in the Election Supervisor's decision of record in this case, the decision is in all respects affirmed. Furthermore, I decline to require the Election Supervisor to conduct the ordered rerun election.
Accordingly, that decision is affirmed.
