ELECTION APPEALS MASTER

GARY HOLZER, Protestor.

This matter is an appeal from the Election Supervisor's decision 2006 ESD 377 issued October 24, 2006.

A hearing was held before me on October 27, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven R. Newmark, Esq. on behalf of the Election Supervisor, David Hoffa, Esq. and Christie Bailey on behalf of the Hoffa 2006 Slate, Joseph Kaplon, Esq. on behalf of Local 848 and Barbara Harvey, Esq. on behalf of Teamsters for a Democratic Union.

An officer and shop steward of Local 640 called a union meeting in the workplace and both made a partisan political speech and distributed campaign literature to those in attendance. No notice of equal time had been given to the opposition.

The Election Supervisor, funding a clear violation of the Election Rules, ordered the Local to pay for a Leedham Campaign mailing.

The decision is in all respects affirmed.
