This matter is an appeal from the Election Supervisor's decision 2010 EAD 22 issued August 27, 2010. The appeal was submitted by Lucio Reyes, Secretary-Treasurer of Teamsters Local Union 601.
A hearing was held before me on September 2, 2010. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; David J. Hoffa, Esq. on behalf of the Hoffa-Keegel Campaign, Rome Aloise, member and principal officer of Local Union 853 and president of Joint Council 7, and Lucio Reyes.
The appeal in this matter does not challenge the findings of fact or the imposed remedies of the Election Supervisor's decision. Reyes, a candidate for IBT vice president for the West region, who was found to have committed multiple violations of the Election Rules, argues only that the election protests filed against him by Aloise and Hoffa-Keegel 2011, were not filed on a timely basis under the Election Rules.
The Election Supervisor found that Aloise filed his protest on July 11, one day after learning of the alleged Rules violations, and the Hoffa Campaign filed its protest against the Gegare Campaign on July 14, two days after learning of the alleged Rules violations. During the hearing, Reyes conceded that he had no evidence that would establish knowledge on the part of the protestors of the alleged Rules violations on dates prior to those cited by the Election Supervisor.
Accordingly, the appeal is dismissed and the decision of the Election Supervisor is affirmed.
