IN RE: ELIGIBILITY OF VERNON GAMMON, Protestor.

ORDER

This matter is an appeal from the Election Supervisor's decision 2011 EAD 100 issued February 6, 2011. The appeal was submitted by Vernon Gammon, Delegate-Candidate on the Gammon/McGaha Team391 Slate and Secretary-Treasurer of Teamsters Local Union 391.

A hearing was held before me on February 16, 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; Griff Morgan, Investigative Officer; Maureen Geraghty, Investigative Officer; Mike Webb, a member of Teamsters Local Union 391 and Vernon Gammon the protester.

The Election Supervisor has filed a motion to dismiss the appeal on the grounds of untimely filing and failure to specify the basis for the appeal in violation of requirements clearly set forth in the explicit notice plainly set out at the conclusion of all of the Election Supervisor's decision, under Article XIII, Section 2(i) and (j).

Here the appeal indisputably fails to set forth an adequate statement explaining why the case was wrongly decided. Both Mr. Gammon and Mr. Webb conceded this during the hearing.
