ORDER
This matter is an appeal from the Election Supervisor's decisions 2011 ESD 189 and 2011 ESD 190, consolidated for purposes of the appeal. Both decisions issued March 28, 2011.
A hearing was held before me on April 5, 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; Denise Ventura, Investigator and Regional Director for the Election Supervisor; Bill Kane, Investigator for the Election Supervisor, and Gary Fabiano the appellant.
The Election Supervisor moves to dismiss these appeals because copies of the appeals and supporting statements submitted to the Election Appeals Master were not served upon or provided to the Election Supervisor on his staff.
During the hearing appellant did not contradict this assertion. Accordingly, pursuant to Article XIII, Section 2(i) of the Election Rules, these appeals are dismissed.
