ORDER

This matter is an appeal from the Election Supervisor's decision 2011 ESD 323 issued on September 11, 2011. A hearing was requested by David J. Hoffa, Esq. on behalf of Jay Phillips.
A hearing was held before me on September 15, 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor's Office; Barbara Harvey, Esq. on behalf of Teamsters for a Democratic Union; Richard Galvan of Local Union 396; David J. Hoffa, Esq. for Jay Phillips and Jay Phillips, President of Local Union 396.
As noted in the appeals hearing, the less said about this deplorable case the better. The decision of the Election Supervisor is in all respects affirmed. The stay of remedy is vacated.
