Gentlemen:
Local Union 710 held its nomination meeting on January 28, 1996 at which Ray Ortiz was nominated as a candidate for delegate to the International convention. By letter received by the Election Officer on January 29, 1996, Robert Pusateri protests Mr. Ortiz's eligibility to run for this position. Mr. Pusateri makes no specific allegation in his protest.
Article VII, Section 1 of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election ("Rules") provides that to be eligible to run for delegate to the International convention, a member must:
(1) Be a member in continuous good standing of the Local Union, with one's dues paid to the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination for said position with no interruptions in active membership due to suspensions, expulsions, withdrawals, transfers or failure to pay fines or assessments;
(2) Be employed at the craft within the jurisdiction of the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination.

The Election Officer's investigation shows that Mr. Ortiz was employed by Roadway Express for the 24 months prior to January 1996 and that his dues were deducted by his employer during that period. According to records from the local union, Mr. Ortiz's dues were remitted on time by his employer for each month of the 24-month period.
As Mr. Ortiz satisfies the requirements for eligibility set forth in the Rules, the Election Officer finds he is eligible to run for delegate in Local Union 710. Accordingly, the protest is DENIED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
