Gentlemen:
The Election Officer determined that Frank Wsol was eligible to run for delegate to the International convention on January 24, 1996. Mr. Wsol was nominated for delegate at the Local Union 710 nomination meeting held January 28, 1996. Slobodan Golubovic, a member of Local Union 710, filed a protest challenging the eligibility of Mr. Wsol because he allegedly failed to pay a fine and assessment ordered by the IBT General Executive Board.
Article VII, Section 1(a) of the Rules for the IBT 1995-1996 International Union Delegate and Officer Election (“Rules”) provides:
(a) To be eligible to run for any Convention delegate, alternate delegate or International Officer position, one must:
(1) Be a member in continuous good standing of the Local Union, with one’s dues paid to the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination for said position with no interruptions in active membership due to suspensions, expulsions, withdrawals, transfers or failure to pay fines or assessments;

(2) Be employed at the craft within the jurisdiction of the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination; and
(3) Be eligible to hold office if elected.
By letter dated February 17, 1995, the General Executive Board ordered Mr. Wsol to pay a fine of one-sixth of $21,161. During the investigation of this protest, Local Union 710 confirmed that Mr. Wsol paid his fine by presenting to the Election Officer a copy of
Mr. Wsol’s check dated March 10, 1995, payable to the local union in the amount of $3,527.00. The Election Officer is therefore satisfied that Mr. Wsol’s membership was not interrupted by a failure to pay a fine or assessment. Accordingly, it is the determination of the Election Officer that Mr. Wsol is eligible to run for delegate from Local Union 710 to the International convention.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
