Gentlemen:
Mario Ferenac, a member of Local Union 385, filed a protest challenging the eligibility of Local Union 385 member Tofek Saleeba, who was nominated on January 27, 1996 to run for delegate to the International convention as defined by the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”).
In Peterson, E-076-LU385-EOH (February 5, 1996), the Election Officer ruled that Mr. Saleeba was not eligible to run for delegate. There, the Election Officer found that
Mr. Saleeba had not maintained 24 months continuous good standing as required by the Rules.
Accordingly, the Election Officer considers the instant protest resolved by her decision in Case No. E-076-LU385-EOH.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
