Dear Sir:
In response to a request for pre-nomination eligibility verification, on February 5, 1996 the Election Officer found Donald J. Duignan ineligible to nominate or second a nomination for delegate or alternate delegate to the International convention. Mr. Duignan protested this determination in a letter received by the Election Officer on February 8, 1996.
An investigation revealed that Mr. Duignan did not nominate or second a nomination at Local Union 726's nominations meeting on February 16, 1996. Since the deadline for nominations in Local Union 726 has passed, the issue raised in this protest is moot and the protest is DENIED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
