Re: Election Office Case No. E-094-LU726-EOH
Gentlemen:
An eligibility protest was filed pursuant to Article XIV, Section 2(b)(1) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by
Bob Esposito, a member of Local Union 726. The protester disputes a finding by the Election Officer that he is not eligible to nominate or second the nomination of candidates for delegate or alternate delegate to the International convention. Mr. Esposito now advises the Election Officer that he wishes to withdraw his protest. The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
