IN RE: MICK KELLY and ERIK JENSEN, Protestors.
Protest Decision 2006 ESD 77
Issued: February 9, 2006
OES Case No. P-06-095-013006-MW

Mick Kelly and Erik Jensen, members of Local Union 320, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2005-2006 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that the local union interfered with members' rights to inspect and make notes from collective bargaining agreements covering members of the local union, in violation of Article VII, Section 1 of the Rules.

On February 6, 2006, the protestors requested to withdraw this protest as premature.

We grant the protestors' request and deem this protest WITHDRAWN.
