Jimmy Payne, a member of Local Union 728, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2005-2006 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that local union secretary-treasurer Larry McDonald failed to post the notice of nominations meeting results at the UPS Hub in Atlanta, in violation of the Rules.

Election Supervisor representative Dolores C. Hall investigated this protest.

Findings of Fact

On January 21, 2006, Local Union 728 held its nominations meeting. Payne, a shop steward for UPS, alleged that he did not receive the posting of nominations meeting results from McDonald after the meeting within five days after the meeting as required by the Rules.

McDonald told our investigator that he emailed the notice to all the shop stewards for posting. McDonald said that only one job steward, Phil Prince, located at the same UPS hub as Payne, complained of not getting the notice.

Upon learning of the error at the UPS hub in Atlanta, McDonald immediately emailed the shop steward with explicit instructions that he personally deliver a copy to Payne. Payne confirmed that he received the notice and that it was, in fact, posted.

Analysis

Article II, Section 5(a) and (b) of the Rules state that a "[A]s soon as possible but in no event later than five (5) days following the nomination meeting(s), the Local Union Secretary-Treasurer shall post on all Union bulletin boards a list of all nominated candidates, by name (and by slate affiliation, if known at the time). When the number of nominees for delegate or for alternate delegate does not exceed the number to be elected to that position, the list to be posted shall state that such nominees have been declared elected. A copy of this posting shall be sent immediately to the Election Supervisor. Within three (3) days of such posting, the Local Union Secretary-Treasurer shall provide to the Election Supervisor an affidavit attesting that the list of nominated candidates was posted as required, identifying the Union bulletin board sites at which the list was posted and the name and title of the individual with responsibility for posting the list at each site."
We find that McDonald emailed shop stewards with the required notice and did not learn that the shop steward at UPS Atlanta did not receive the notice until this protest was filed. He remedied the situation promptly by providing the nominations meeting results for posting at that facility. There is no evidence of any malicious intent on the part of McDonald.

Accordingly we deem this protest RESOLVED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal and shall be served upon:
