In Garcia, 2006 ESD 193 (April 20, 2006), we found that Doug Brown had violated the Rules and ordered that he complete a remedy for that violation. On April 25, 2006, Brown appealed our decision. At a hearing on the appeal held May 5, 2006, Brown requested an adjournment so that he could retain legal counsel to represent him in the proceeding; the Election Appeals Master granted Brown's request and adjourned hearing on the appeal to May 11. Also on May 5, Brown requested that we stay our decision pending the outcome of the appeal.
We GRANT Brown's request and STAY our decision pending the outcome of the appeal before the Election Appeals Master.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal and shall be served upon:
