In Rivers, 2011 ESD 137 (February 24, 2011), we found a violation of the Rules and ordered a multi-part remedy, including a notice posting by Local Union 237 on all worksite bulletin boards to advise all local union members that the counting of ballots has been rescheduled from March 2 to March 15, 2011. We ordered that this notice posting be completed by Monday, February 28, 2011.
We issue this supplemental decision to extend the time for completing posting of that notice two days to Wednesday, March 2, 2011. We do so for two reasons. First, the notice must be posted in English and Spanish, and a Spanish language version of the notice was not available at the time the decision issued and will first be available today, Friday, February 25. Second, New York City schools, where many local union members are employed, are closed until Monday, February 28, because of mid-winter break, presenting logistical obstacles to completing the posting by that date.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
