David Kremer, Eric Jensen, and Wade Laszlo, members of Local Union 320 and candidates for delegate on the Anybody But Hoffa slate, filed pre-election protests pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest filed by Kremer and Jensen alleged that the local union violated Article VII, Section 7(a)(4) governing campaign access to an email address list maintained by the local union. Laszlo's protest alleged that the local union's website impermissibly linked to another website that contained campaign advocacy.
Election Supervisor representative Joe Childers investigated these protests.
Pursuant to Article XIII, Section 2(f)(2), we deferred decision on these protests until after the delegates and alternate delegates election at Local Union 320, thereby treating these matters as post-election protests pursuant to Article XIII, Section 3. Except for protests alleging threats, coercion, intimidation, violence or retaliation, post-election protests shall be considered and remedied only if the alleged violation may have affected the outcome of the election.
All candidates on the Anybody But Hoffa slate won their elections for delegate and alternate delegate. Accordingly, the alleged violations, even if proven, did not affect the outcome of the election.
Accordingly, we DISMISS these protests.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
