IN RE: ALEX SPANGENBERG, ) Protest Decision 2011 ESD 272
) Issued: June 3, 2011
Protestor. ) OES Case No. P-271-051711-AT
____________________________________)
Alex Spangenberg, member and IBT convention delegate from Local Union 71, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election (“Rules”). The protest alleged that Local Union 71 violated the Advisory Regarding Payment of Expenses for Convention Delegates by arranging air travel for the elected delegates that risked depriving them of the minimum seven days and six nights at the convention site the Advisory requires.
Election Supervisor representative Maureen Geraghty investigated this protest.
After intervention by our investigator, the local union consented to rebook air travel to insure that the minimum time the Advisory required at the convention site was honored.
After the air carrier confirmed the rebooking, protestor Spangenberg requested to withdraw the protest. Finding that the purposes of the Rules are served by the withdrawal request, we deem this protest WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision.
