Fred Zuckerman, candidate for International office, filed a protest pursuant to Article III, Section 5(n) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election (“Rules”). The protest alleged George Tedeschi was improperly nominated for the position of International vice president at large because the nominator failed to identify Tedeschi by name during the nomination speech.
Election Supervisor representative Jeffrey J. Ellison investigated this protest.
Video recording of the Tedeschi nomination showed that the nominator, John Agenbroad, failed to identify Tedeschi by name. However, the nominator identified Tedeschi by positions held with the GCC and the IBT and also stated his accomplishments. The seconder identified Tedeschi by name, and Tedeschi accepted the nomination on the floor of the convention, stating his name. This review demonstrated that the statements of the nominator, seconder and candidate, taken together, sufficiently identified the candidate to state a valid floor nomination. Based on this review, counsel for the protestor requested to withdraw this protest. Finding that permitting withdrawal furthers the purposes of the Rules, we deem this protest WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
