Richard Galvan, member of Local Union 396, filed three separate pre-election protests pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election (“Rules”). Each protest alleged that particular named employers, CR&R Incorporated Waste & Recycling, Rainbow Disposal, and Waste Management, interfered with the protestor’s right to campaign on the employer parking lots where local union members parked their vehicles while working.
Election Supervisor representative Maureen Geraghty investigated these protests.
By email received October 24, 2011, the protestor requested to withdraw each protest. We find that permitting withdrawal is consistent with the purposes of the Rules. Accordingly, we deem these protests WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
