David Hedberg filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2015-2016 IBT International Union Delegate and Officer Election (“Rules”). The protest alleged that Joe Witzmann is ineligible for nomination as delegate to the IBT convention for alleged failure to maintain 24 consecutive months of good standing. Specifically, the protest alleged that, in months when Witzmann was a cash dues payer, he suffered an interruption in continuous good standing by paying his dues after the first day of the month, even though he paid his dues before the last business day of the month.
On January 13, 2016, protestor Hedberg requested to withdraw the protest. Concluding the purposes of the Rules are served by the withdrawal request, we deem this protest WITHDRAWN. Witzmann’s name shall appear on the ballot in Local Union 1145’s delegates and alternate delegates election.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
