In Brady et al, 2023 ESD 189 (May 26, 2023), we found Rules violations and ordered a remedy, which included inter alia reinstatement to employment. The IBT timely appealed and requested that the Election Supervisor stay the remedy, urging that implementation of it should await resolution of the appeal.
We stayed all aspects of the remedy ordered in Brady pending resolution of the pending appeal or further order. Brady et al, 2023 ESD 190 (May 26, 2023).
The Election Appeals Master affirmed our decision in all respects, including all elements of the remedy we ordered. Brady et al, 2023 EAM 26 (November 8, 2023). The appellate decision operated to DISSOLVE the stay in all respects. If it has not done so already, the IBT is required to implement the ordered remedy forthwith.
