RE: Election Office Case No. P-103-LU682-MOI

 

Gentlemen:

 

A pre-election protest was filed with the Election Officer pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by Richard Hathaway and Roy White, members of Local Union 682.  By separate letters dated July 2, 1995 Mr. Hathaway and Mr. White contend that Local Union 682 has failed to comply with their written requests to provide a list of work sites and to inspect the collective bargaining agreements covering members of the local union.

 

The Election Officer has been advised that Mr. Hathaway and Mr. White were mailed a worksite list on July 7, 1995, and that the parties were notified via letter that they could examine the collective bargaining contracts upon request. 

 

                Both Mr. Hathaway and Mr. White confirmed that they had received the worksite list and are aware that they will be permitted to examine the collective bargaining contracts through arrangements with the Local Union.

Under these circumstances, the Election Officer concludes that further processing of this protest is unwarranted.  The protesters complaints as contained in this protest have been addressed, and the relief requested has been achieved.  Accordingly, the protest is now RESOLVED.

 

Any  interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of  receipt of  this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
