Gentlemen:
A pre-election protest was filed with the Election Officer pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by Johnny Platt, a member of Local Union 41. By letter dated July 4, 1995, Platt contends that James P. Hoffa should be disqualified from seeking International office because he has waged a public relations campaign attacking the government and the enforcement of the Consent Decree.
These charges were investigated by Regional Coordinator Mike Gordon. The protester has presented no evidence to support a finding that any provision of the Rules has been violated. This protest is, therefore, DENIED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
