Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(a) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by

Timothy Casey, a member of Local Union 710.  Mr. Casey alleges that Local Union 710 Secretary-Treasurer Frank Wsol posted a signed copy of the Notice of Submission of Local Union Plan, in violation of Article II, Section 4(g) of the Rules, which provides, “Except where otherwise provided by the Rules, every posting by the Union on Union bulletin boards required by this or any other provision of the Rules shall be on Union letterhead that has no names of Union officers, business agents, staff or the like.”  Posting of a notice on all union bulletin boards advising that a local union plan has been submitted is required by Article II, Section 4(f).

 

This protest was investigated by Julie Hamos.

 

The Election Officer has been advised that upon being apprised of the protest, Local Union 710 Secretary-Treasurer Wsol removed all copies of the Notice containing his signature from local union bulletin boards and replaced them with copies on Local Union 710 letterhead without the names of any officers or employees of the union.  Under these circumstances, the Election Officer concludes that further processing of this protest is unwarranted.  The protester’s complaint as contained in this protest has been remedied.

Accordingly, the protest is RESOLVED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
