Gentlepersons:

 

This protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by Rita Leapheart, a a member of Local Union 283.  The protester takes issue with the Election Officers disqualification of Gerald Hunter.

 

The protest was investigated by Regional Coordinator Bill Wertheimer.

 

Local Union 283’s nomination meeting was held February 4, 1996.  At the meeting, Rita Leapheart nominated Gregory Hunter to run for delegate to the International convention.  George Evans seconded Mr. Hunter’s nomination.  By letter received by the Election Officer on February 7, 1996, Kathy Haynes protested the eligibility of Mr. Hunter to run for delegate.  The Election Officer, in eligibility decision E-089-LU383-EOH (February 22, 1996), determined that Mr. Hunter was not eligible to run for delegate or alternate delegate because he had not maintained good standing for 24 consecutive months, as required by the Rules.

 

The investigation revealed that Mr. Hunter did not appear the Election Officer’s determination that he was eligible.  Thus, the Election Officer’s decision stands.  Ms. Leaphart may not appeal the Election Officer’s determination on behalf of Mr. Hunter.  Hence, the protester has failed to substantiate any allegations of Rules violations.

Accordingly, the protest is DENIED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
