Re: Election Office Case No. P-527-LU726-CHI
Gentlemen:
Thomas V. Judkins, a member of Local Union 726 filed a protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) alleging that Charles L. Bailey, a candidate for delegate, has misrepresented himself because he has been designated on the Nomination Meeting Report for Local Union 726 as “Carlos” Bailey. The Regional Coordinator has corrected the designation of Mr. Bailey on the report. Mr. Judkins now advises the Election Officer that he wishes to withdraw his protest. The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
