Gentlemen:
Terry D. Post, a member of Local Union 216, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) alleging that Local Union 216 Secretary-Treasurer Phil Tarantino used union facilities and equipment to file and address protests. The protester also alleges that such activities occurred while Mr. Tarantino was on union-paid time. Based upon prior decisions of the Election Officer, Mr. Post now advises the Election Officer that he wishes to withdraw his protest. The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
