Re: Election Office Case No. P-803-LU481-CLA
Gentlemen:
Thomas Miller, secretary-treasurer of Local Union 481, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against AMPCO/System Airport Parking (“AMPCO”) in San Diego, California. The protester alleged that AMPCO was refusing to allow Jesus Pacheco, a delegate from Local Union 481, time off from work to attend the 1996 International Convention. The protester now advises the Election Officer that AMPCO will allow the delegate time off and, therefore, he wishes to withdraw his protest. The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
Thomas Miller
