Re:  Election Office Case No. P-805-LU812-NYC

 

Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the IBT International Union Delegate and Officer Election ("Rules") by Ron Smith, a member of Local Union 728, alleging that Local Union 812 President Anthony Rumore violated the Rules by using local union resources to produce and distribute a letter to delegates to the IBT Convention in an attempt “to solicit information to advance the campaign and candidacy of

Mr. Hoffa.”  Mr. Smith now advises the Election Officer that he wishes to withdraw his protest.  The Election Officer, finding that withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
