Gentlemen:
Mike Worley, a member of Local Union 572, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against the Hoffa campaign and the University of California at Berkeley (“UC-Berkeley”). The protester alleges that UC-Berkeley, an employer, made an unlawful contribution to the campaign of Mr. Hoffa by distributing material supporting his campaign over the Internet.
Mr. Worley now informs the Election Officer that he wishes to withdraw the protest. Finding that the requested withdrawal effectuates the purposes of the Rules, the Election Officer permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
