Gentlemen:

 

Dan Freese, a member of Local Union 320, filed a pre-election protest pursuant to

Article XIV, Section 2(b) of the Rules for the IBT International Union Delegate and Officer Election ("Rules") alleging that Local Union 320 Trustee Harold Yates told him not to distribute Hoffa campaign material in the hallway outside the meeting rooms at Teamsters Hall, located at 3001 University Ave., S.E., in Minneapolis, Minnesota, and further told him not to attend bargaining unit meetings there.  Mr. Freese contends that other members have been permitted to distribute Carey campaign material in the hallway.

 

After discussion with Regional Coordinator Judith Kuhn, Mr. Yates states that he will not object to campaigning by Mr. Freese in the hallway before and after Local Union 320 member-ship meetings.

 

The protester now advises the Election Officer he wishes to withdraw his protest.  The Election Officer, finding that the requested withdrawal effectuates the purposes of the Rules, permits this protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
