Gentlemen:
Ken Mee, a candidate for re-election for International vice president in the Western region, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”). The protester alleged that Chuck Mack, secretary-treasurer of Local Union 70 and a candidate for International vice president in the Western region, Bob Carr, secretary-treasurer of Local Union 624, and Matt Russell, a business agent for Local Union 624, utilized a union-owned automobile to transport Mr. Mack and other members of the Hoffa No Dues Increase slate to engage in campaign activities on union-paid time. Mr. Mee now advises the Election Office that he wishes to withdraw his protest.
The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.
