Gentlemen:
A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by
Bill Liebold, a member of Local Union 831. Mr. Liebold alleged that a supervisor at his work site told him he would be subjected to disciplinary action if he continued to post Carey ‘96 stickers at his work site and that campaign materials supporting James P. Hoffa, a candidate for general president, had been posted on bulletin boards at his work site. The protester further alleged that he had been denied a vacation change by his employer apparently due to his support of Ron Carey for general president. Mr. Liebold now advises the Election Office that he wishes to withdraw his protest.
The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.
