Gentlemen:
Larry “Crash” Hartigan, a member of Local Union 705, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) contending that the IBT funds used to pay for an IBT-sponsored voter registration rally at Teamster City in Chicago on October 6, 1996 were from the IBT Organizing Department and not from the IBT’s political action fund, DRIVE.
The IBT responds that the protester has not stated a violation of the Rules.
This protest was investigated by Regional Coordinator Julie E. Hamos.

The protest makes no allegation that any campaigning occurred at the Chicago voter registration rally. The Rules prohibit the use of union funds for campaign activities or campaigning. However, since there is no evidence of campaigning, this union-financed rally was not in violation of the Rules. Which department of the IBT may have financed the rally is not within the purview of the Election Officer.
Accordingly, this protest is DENIED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
