Pre-election protests were filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by Rebecca Clemerson, a member of Local Union 783.  In P-1105, Ms. Clemerson alleged that Mike Smith, a foreman at President’s Baking in Louisville, Kentucky, was removing campaign materials that she and other employees were placing on cars in the employee parking lot, in violation of the Rules.  In P-1106, Ms. Clemerson alleged that employees of President’s Baking were allowed to wear campaign material in support of James P. Hoffa, a candidate for general president, for approximately two weeks, but the same opportunity was not afforded supporters of Ron Carey, IBT general president and a candidate for reelection.  Ms. Clemerson now advises the Election Officer that she wishes to withdraw the above-mentioned protests.

 

The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
