James P. Hoffa, a candidate for general president, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) that the National Lawyer’s Guild (New York City Chapter), Ron Carey, IBT general president and a candidate for re-election, Victor Rabinowitz and the law firm of Rabinowitz, Boudin, Standard, Krinsky and Lieberman, P.C., Carlin Meyer,
New York University, Brent Garren, the Union of Needle Trades, Industrial and Textile Employees (“UNITE”) and Anne Helen Hess violated Article XII of the Rules. Specifically, the protester alleged that a Carey campaign fundraiser planned by the charged parties and scheduled to take place on October 29, 1996 was in violation of the Rules because all or some of the charged parties who are sponsoring the fundraiser constitute employers or labor organizations which are forbidden from soliciting or making contributions to Mr. Carey’s campaign.
The protest was investigated by Protest Chief Benetta Mansfield.
On October 16, 1996, a letter went out to “Members, Labor Committee of the New York City Chapter of the National Lawyers Guild” from Victor Rabinowitz, Carlin Meyer and Brent Garren. The letter was an invitation to a Ron Carey fundraiser at the home of
Anne Helen Hess on October 29, 1996, and asked for funds even if the invitee could not attend. A more general fundraising solicitation attached to a more general invitation to the fundraiser suggested a minimum contribution of $100.
On October 23, 1996, the Carey campaign advised the Election Officer that the fundraiser had been cancelled. The Carey campaign further has agreed that all checks which had been received or are received by the Carey campaign in response to the October 16, 1996 letter will be returned. The Election Officer directs that the Carey campaign provide an affidavit indicating the checks that have been received and confirming that those checks have been returned.
Accordingly, the protest is RESOLVED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
