Re:  Election Office Case No. P-1130-RCS-EOH

 

Gentlemen:

 

James P. Hoffa, a candidate for general president, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) alleging that Mr. and Mrs. Irving Bluestone, Bill Hamilton,

Msgr. George Higgins, Wayne and Ann Horwitz, Ellie Newman, Jules and Kathy Pagano, Steve and Nancy Schlossberg, Jack Sheinkman, Mildred Wurf and the Carey campaign violated Article XII of the Rules.  Specifically, the protester alleged that a Carey campaign fundraiser planned by the charged parties, which occurred on September 30, 1996, was in violation of the Rules because some of the charged parties who sponsored the fundraiser constitute employers or employer representatives that are forbidden from soliciting or making contributions to Mr. Careys campaign.  The protester also alleged that employers attended the fundraiser and made contributions to the Carey campaign, in violation of Article XII,

Section 1 (b)(2) of the Rules that only permits receipt of earmarked contributions from employers for legal and accounting purposes. 

 

The protest was investigated by Election Office Representative Kathryn Naylor.

The fundraiser at issue was held on September 30, 1996.  On November 13, 1996, the Carey campaign advised the Election Office that it will return all funds collected at the fundraiser and received in response to the solicitation/invitation for the fundraiser.  By Monday, November 18, 1996, the Election Officer directs the Carey campaign to provide an affidavit attesting to when it returned the contributions and the total amount returned.  The Carey campaign shall attach to its affidavit copies of the checks returning these contributions.

 

Accordingly, the protest is RESOLVED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
