Re:  Election Office Case No. P-1174-IBT-PNW

 

Gentlemen:

 

Clint C. Kaiser, secretary-treasurer of Local Union 66, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) alleging that IBT International Organizer Gordy Teller and an unknown companion distributed Carey campaign material in Local Union 66 workplaces on union-paid time.  He also alleges that during such workplace visits, Mr. Teller has been supporting Mr. Kaiser’s opponent in the Local Union 66 officer election, Doug Palady, in retaliation for Mr. Kaiser’s support for James P. Hoffa.

 

Mr. Teller responds that he has made short, pro-Carey campaign visits to several Local Union 66 workplaces since October 18, 1996, while on vacation time.  He further admits that he has had some conversations about Mr. Palady.

This protest was investigated by Regional Coordinator Christine M. Mrak.

 

Mr. Teller acknowledges campaigning in the Smith Bros. Company lunch room for approximately 15 minutes, mentioning Mr. Palady to someone in the course of conversation, and being accompanied by another member named Kirk Stephenson.

 

With respect to Mr. Kaiser’s allegation that Mr. Teller campaigned while on union-paid time, Mr. Teller furnished the Election Officer with documentation showing that he took half or full days of vacation from October 28 to November 27, 1996.

 

With respect to Mr. Kaiser’s allegation that Mr. Teller retaliated against him by talking favorably about Mr. Kaiser’s opponent in Local Union 66’s officer election, this pertains to the local union election, over which the Election Officer has no jurisdiction.

 

For the foregoing reasons, the protest is DENIED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
