Gentlepersons:
Glenn Baker and Theresa Byram, both members of Local Union 63, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against Price Costco in Irvine, California. In their protest, Mr. Baker and Ms. Byram alleged that they were denied access to campaign on the premises of Price Costco on November 7, 1996. Since the filing of this protest, Mr. Baker and Ms. Byram attempted to campaign at the facility again and were permitted access. Therefore, they have informed the Election Office that they wish to withdraw the protest.
The Election Officer, finding that the withdrawal effectuates the purposes of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.
