Re:  Election Office Case No. P-1289-LU810-EOH

 

Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by

Steven G. Gilman, secretary-treasurer of Local Union 810.  Mr. Gilman alleges that Local Union 180 retiree Charles Wiseman received a call from a woman who identified herself as calling from Hoffa Headquarters in Brooklyn, New York.  Mr. Gilman states that this woman asked Mr. Wiseman whether he had voted and who he was voting for.  Mr. Gilman states that

Mr. Wiseman feels that these requests were an invasion of privacy.

 

The conduct protested herein is identical to other phone bank operations where members are contacted by campaign representatives and asked to vote for a candidate or slate.  So long as such activity is not done with the use of union or employer resources, the Election Officer has never held such activity to violate the Rules.

 

Accordingly, the protest is DENIED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
