Gentlepersons:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules

for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by

Mary Ann McIntosh, a member of Local Union 89.  Ms. McIntosh alleges that an unnamed business representative from Local Union 89 campaigned on union-paid time at a UPS facility in Louisville, Kentucky, in violation of Article VIII, Section 11(b) of the Rules.

 

This protest was investigated by Adjunct Regional Coordinator Joe F. Childers.

 

Ms. McIntoshs protest was filed on November 22, 1996.  The protester did not include her telephone number on the protest.  On November 25, 1996, the investigator wrote to her providing his office and home telephone numbers.  Ms. McIntosh never responded.  Because Ms. McIntosh has presented no evidence to sustain her allegations, the Election Officer finds that the Rules were not violated.

 

Accordingly, this protest is DENIED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
