Gentlemen:
Archie Cook, a member of Local Union 705, filed a post-election protest pursuant to Article XIV, Section 3 of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”). The protester alleges that the Regional Coordinator intends to recount the ballots in the Local Union 705 delegate election in order to consider ballots which were cast, but not discovered until after the count held on March 24, 1996. He objects to the proposed recount and any consideration of the ballots discovered after the count. Mr. Cook now advises the Election Officer that he wishes to withdraw his protest. The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal. Requests for a hearing shall be made in writing and shall be served on:
