Re:  Election Office Case No. PR-301-LU320-NCE

 

Gentlemen:

 

Erik Jensen, a member of Local Union 320, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against the University of Minnesota (“University”).  The protester is an employee of the University.  He alleged that on September 19, 1998, he was ordered by a supervisor to remove a campaign button from his clothing.  The button supported Tom Leedham, a candidate for general president. 

 

The protest was investigated by Regional Coordinator Judith E. Kuhn.

 

The Director of Labor Relations for the University of Minnesota advises that the University’s policy permits the wearing of campaign buttons except if they present a threat to anyone’s safety.  Accordingly, the University now agrees that Mr. Jensen may wear his campaign button.  Based on these representations, on Wednesday, October 14, 1998, the protester advised the Election Officer in writing that he wished to withdraw the protest.  The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
