Gentlepersons:

 

David Tucker, a member of Local Union 331, filed pre-election protests pursuant to Article XIV, Section 2(b) of the Rules for 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) alleging that Matthew O’Connor and Robert Ricci posted campaign literature on behalf of James P. Hoffa, a candidate for General President, on the Local Union 331 office while improperly removing the campaign literature of John Morris, a candidate for Eastern Region vice president from a  nearby area.  Mr. Tucker alleged that Mr. O’Connor stated, “Hoffa is in and Joe Yeoman [president of Local Union 331] is on his hit list, baby.”   Mr. Tucker also alleged that Mr. O’Connor threatened members by stating “You guys are going down,” and engaged in racially hostile speech.  Additionally, Mr. Tucker alleged that Mr. Ricci told Mr. Tuckers and others that they were going to be in trouble and out of a job when Hoffa takes office.  Finally, Mr. Tucker alleged that Messrs. O’Connor and Ricci punched Tom Moore, a member of Local Union 331 and tackled him to the ground.

 

Mr. Tucker advises the Election Office that he wishes to withdraw his protests.  The Election Officer, finding that the withdrawals effectuate the purposes of the Rules, permits the protests to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
